Nationality: Must be a national of a treaty country with the U.S.
Active Involvement: Must come to the U.S. to develop & direct the enterprise, showing a commitment to the business's success.
Enterprise Viability: The business must be more than marginal, generating significant income or economic impact.
Business Ownership: Must have a controlling interest in the enterprise (at least 50% ownership).
